These Terms of Service ("Terms") govern your use of the web hosting, WordPress hosting, VPS, domain registration, SSL certificates, backups, malware protection, and other related services (collectively, the "Services") provided by Hostbun ("we", "us", or "Hostbun"). Hostbun is based in Kolkata, West Bengal, India.

By signing up for, accessing, or using our Services, you ("you", "your", or the "Customer") agree to be bound by these Terms. If you do not agree, please do not use our Services.

You must be at least 18 years old to use our Services.

1. Services

We provide shared hosting, WordPress hosting, unmanaged VPS, domain registration, SSL certificates, backups (where offered for free on certain plans), malware protection, and related services.

  • Shared/WordPress Hosting: Resources (CPU, RAM, storage, inodes, etc.) are limited as per your chosen plan. We offer unmetered bandwidth subject to fair use – you agree not to misuse bandwidth in a way that negatively affects other customers or our network.
  • VPS Services: Our VPS plans are fully unmanaged. You receive full root access and are solely responsible for configuration, security, software installation, updates, backups, and all content/activity on your VPS.
  • We may use third-party providers for parts of the Services and are not responsible for their actions or outages.

2. Acceptable Use

You agree to comply with our separate Acceptable Use Policy (AUP), available at https://hostbun.com/acceptable-use-policy.

We may suspend or terminate your account immediately, without refund, for any violation of these Terms or the AUP.

3. Customer Responsibilities

  • You are responsible for all content you upload, host, or transmit.
  • You must maintain secure passwords and protect your account.
  • For VPS: You are fully responsible for security, patching vulnerabilities, and compliance with all applicable laws.
  • You must have all necessary rights to your content and grant us a license to host, reproduce, and distribute it as needed to provide the Services.
  • Backups: We may provide backups on some plans, but you are ultimately responsible for your data. We strongly recommend you maintain your own backups in case of emergency data loss.

4. Payments and Billing

  • You agree to pay all fees on time via accepted methods (including cryptocurrency).
  • Non-payment may result in suspension after 7 days and termination after 30 days.
  • Prices may change with reasonable notice.

5. Refunds

  • We offer a 30-day money-back guarantee on most shared and WordPress hosting services (excluding domains, SSL certificates, add-ons, and payments made via cryptocurrency).
  • No refunds are available for VPS purchases, except in rare cases for yearly plans where we may, at our sole discretion, offer a partial refund on a case-by-case basis (no guarantee).
  • No refunds after the initial 30-day period (where applicable) or for account violations.

6. Termination and Suspension

  • You may cancel your account at any time with notice.
  • We may suspend or terminate your account immediately for violations, non-payment, or any activity that threatens our network or services.
  • Upon termination, we may delete all your data immediately. No refunds will be provided for any remaining term.

7. No Warranties; Limitation of Liability

The Services are provided "as is" and "as available" without any warranties of any kind.

To the maximum extent permitted by law:

  • We are not liable for any indirect, consequential, incidental, special, or punitive damages (including lost profits, data loss, or business interruption).
  • Our total liability for any claim is limited to the amount you paid us in the 12 months prior to the claim.
  • We are not responsible for data loss, security breaches (especially on unmanaged VPS), or service interruptions beyond our reasonable control.

8. Indemnification

You agree to indemnify, defend, and hold harmless Hostbun, its owners, employees, and affiliates from any claims, losses, damages, liabilities, or expenses (including legal fees) arising from your use of the Services, your content, or any violation of these Terms or applicable laws.

9. Force Majeure

We are not liable for any failure or delay in performing our obligations caused by events beyond our reasonable control, such as natural disasters, wars, pandemics, cyberattacks (e.g., DDoS attacks), government actions, or third-party service outages.

10. Privacy

Your personal information and data are handled in accordance with our Privacy Policy, available at https://hostbun.com/privacy-policy. We comply with applicable Indian laws.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or by posting a notice on our website. Your continued use of the Services after such changes constitutes acceptance of the updated Terms.

12. Governing Law and Disputes

These Terms are governed by the laws of India, without regard to conflict of laws principles.

Any disputes arising from or relating to these Terms or the Services shall be subject to the exclusive jurisdiction of the courts in Kolkata, West Bengal, India.

13. Miscellaneous

  • These Terms constitute the entire agreement between you and Hostbun regarding the Services.
  • If any provision is found invalid, the remaining provisions remain in full effect.
  • We may assign these Terms without your consent; you may not assign them without our written approval.
